BREAKING: Tobyhanna Fire Company Files Suit Challenging Legality of Fire Ordinance

STROUDSBURG —Late this afternoon the Tobyhanna Township Fire Company filed suit  against the township over the recently-adopted “Fire Ordinance.” The litigation was filed in the Monroe County Court of Common Pleas in Stroudsburg.

Court records show the proceeding was registered shortly before 4pm today. The case was commenced with a “Writ of Summons.” That is a method of filing a claim without filing a complaint detailing the facts and nature of the claims. Typically, the other side responds with a demand for a complaint, which affords the plaintiff thirty days to file one or suffer dismissal of the proceeding.

While the particulars of the fire company’s claims are unknown, the “Civil Cover Sheet” required at the commencement of civil litigation classifies the action as one challenging the legality of an ordinance.
